The $50 of Weekly Fuel Draw is sponsored by AskKinjo Inc.  (the "Company").  By entering, you agree to comply with and be bound by the following official rules (the "Rules").  Please review the Rules carefully.  If you do not agree to the Rules in their entirety, you are not permitted to enter the Contest.

Bullet PointELIGIBILITY.

The Weekly Fuel Draw is open to legal residents of Ontario, living within 100 Km from the city of Toronto and who are at least 18 years of age. Employees, officers and directors of the Company, and their affiliates, parents, subsidiaries, Contestal fulfillment and marketing agencies and immediate families (and those living in the same households) are not eligible to enter the Weekly Fuel Draw.


Bullet PointHOW TO ENTER

Pre-requisite: Contestants must be registered users before entering the Weekly Fuel Draw. Individuals become a Registered user by completing the Company's website Registration page, completing the online Registration form and validating their email address and mobile phone number as instructed. Each contestant must complete all registration fields including, but not limited to their postal code, phone number, and e-mail address.

How to enter: Contestants may enter the Weekly Fuel Draw by using the #KINJO service every week by calling #KINJO from their registered mobile phone and listening to the audio advertising message. Rogers and Fido users must dial 647-476-6468 until further notice. All entries must be received between twelve a.m. (12:00:00 a.m.) Eastern Standard Time (EST) on Monday and fifty-nine (59) minutes and fifty-nine (59) seconds past eleven p.m. (i.e. 11:59:59 p.m.) Eastern Standard Time (EST) on Sunday. Entries will be accepted every day, including legal holidays. Each complete entry will be automatically entered into our draw. Only one (1) entry per contestant per calendar week will be eligible to win. By registering for the Weekly Fuel Draw, contestants also agree to accept e-mail messages and SMS from the Company and their respective advertising affiliates (hereinafter referred to as "Advertisers").


Bullet PointHOW TO WIN

Before March 31, 2009 at twelve a.m. (i.e. 12:00:00 a.m.), one entry per calendar week will be selected at random from all eligible entries. If your Entry has been selected, you shall be the prizewinner. Winner will be notified via e-mail within one (1) week after the winner is determined (contestants should ensure that their contact information is accurate and up to date). In addition, the company will attempt to contact winner by telephone or SMS. Winner will be subject to eligibility verification within 2 weeks of the notification. Non-compliance within this time period may result in forfeiture of the giveaway. The winner will be required to provide proof of use of his/her phone number, such as a bill from their wireless service provider with the proper address for delivery of the prize. Return of any prize/prize notification as undeliverable will result in forfeiture. In no case shall the Company be liable in any manner where a winner has not received notification sent from the Company or where the Company fails to receive a response from the winner within the required response period. If a winner is not available or unable to contact the company, then the company will draw a new winner and repeat the process. This process will be repeated up to five (5) times until prize is collected by a winner.


Bullet PointPRIZE DESCRIPTION

A $50 gift card to be redeemed only for fuel at any gas station selected by the Company at the time of the draw; the card may not be redeemed for cash. The Company cannot replace lost or stolen cards. Cards must be presented to cashier at time of purchase.

The Contest period begins November 10th 2008 and ends March 31st 2009.  All entries must be received by 11:59:59 p.m. EST on March 31st 2009.

Federal, provincial and local taxes, and all similar fees and assessments, are the responsibility of the winner, in no way will the Company Inc. be liable for the winners fees or taxes.


Bullet PointNO SUBSTITUTION OF WINNERS

No substitution or transfer of prizes will be accommodated or permitted, except in the Company’s sole discretion. 


Bullet PointPUBLICATION

Weekly Fuel Draw entry constitutes permission for the Company to use winner’s name and any information released by the contestant for advertising and Contestal purposes on the Website without further compensation.


Bullet PointRELEASE

By entering the Weekly Fuel Draw, each contestant agrees to release and hold harmless the Company, each of their legal representatives, their affiliates, subsidiaries, parents, agencies and their respective officers, directors, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from, or in connection with, the Weekly Fuel Draw including, but not limited to, liability arising from copyright infringement, improper use of likeness, personal injury, death, damages or monetary loss. Restrictions, conditions and limitations apply. By entering, each contestant further agrees that, in the event that there is any conflict or other inconsistency between the Rules and any advertisements, Contestal or marketing materials, e-mails or announcements relevant to the Weekly Fuel Draw, these Rules will govern. Any disputes arising out of or related to the Weekly Fuel Draw shall be governed by and construed in accordance with the laws of the Province of Ontario (without regard to conflict of law principles). Should a dispute arise concerning the Weekly Fuel Draw, the parties agree to submit their dispute for resolution in the Ontario Provincial court. Should any part of these Rules be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that the Company’s Website Privacy Policy and/or Terms and Conditions are in conflict or inconsistent with these Rules as they pertain to the Weekly Fuel Draw, these Rules shall take precedence.


Bullet PointDISQUALIFICATION

The Company, each of their legal representatives, their affiliates, subsidiaries, parents, agencies and their respective officers, directors, employees and agents, are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions or technical failure, lost online entries, jumbled, scrambled or misdirected transmissions, or other error of any kind, whether human, mechanical or electronic. If disqualified for any of the above reasons, Company reserves the right to terminate contestant's eligibility to participate in the Weekly Fuel Draw. In the event that any portion of the Weekly Fuel Draw is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Company, which, in the sole opinion of Company, corrupts, or impairs the administration, security, fairness or proper determination of the Weekly Fuel Draw, the Company reserves the right, in their sole discretion, to suspend or terminate the Weekly Fuel Draw or any part of the Weekly Fuel Draw, or any combination of the above. Company, each of their legal representatives, their affiliates, subsidiaries, parents, agencies and their respective officers, directors, employees and agents are not responsible for any problem with entries generated by computer hardware or software malfunction, error or failure, whatever the cause. Company’s sole responsibility for any irregular entry is replacement with another entry. If a potential winning entry is made by Internet or other computer entry, that potential winner may be required to provide the Company with proof that the potential winner is the authorized account holder of the electronic mail address associated with the potential winning entry.

Any attempt by any individual, whether or not a contestant, to damage, destroy, tamper with or vandalize the Weekly Fuel Draw Website, or otherwise interfere with the operation of the Weekly Fuel Draw, is a violation of criminal and civil law and the Company will diligently pursue any and all remedies in this regard against any offending individual or entity to the fullest extent permissible by law and in equity.
